Seasonally x The Bradery

 

Article 1 – Definition and conditions of the competition

The company SYMMETRICS, a simplified joint-stock company with its registered office at 25 rue du Mail 75002 PARIS, registered under number 83944225800027 (hereinafter "the Organizer, the Organizing Company, the Organizers, the Professional") is organizing a competition as part of a marketing operation

The company SEASONLY (hereinafter "the Organizing Company") SASU Single-member simplified joint-stock company, with capital of 393,545 euros registered in the Toulouse Trade and Companies Register under number 817 577 786 RCS with its registered office located at 11 B RUE ANTONIN MERCIE 31000 TOULOUSE , is organizing from 02/07/2023 to 02/14/2023 inclusive, a competition including a €150 voucher to be used on The Bradery and a one-hour treatment in a Seasonly studio (worth €130).

The “Participants” in the competition are also referred to hereinafter as “Participants, Users, Contributors, Players”. The “Winners” in the draw are also referred to hereinafter as “Winners”.

 

Article 2 – Conditions of participation

This game is open to any natural person, of legal age, residing in metropolitan France, after acceptance of the conditions of participation in accordance with the Data Protection Act. Only one participation per natural person is accepted for the entire duration of the Competition. Persons working for SYMMETRICS and SEASONLY and members of their families are excluded from participating in the competition.

 

Article 3 – Competition dates from February 5 to 12 inclusive, 2023

Competition start date: February 7, 2023 at 6:30 p.m.

Contest end date: February 14, 2023 at 12:00 p.m.

Draw date: February 14, 2023

Winners Designation Date: February 14, 2023

 

Article 4 – Terms of participation

4.1) Conditions for submitting an application

To register for the draw and try to win the prize offered in Article 5, all participants must have carried out the actions mentioned below:

• Subscribe to the newsletter www.thebradery.com and check the box authorizing you to receive offers from partners.

OR

• Subscribe to the seasonally.fr newsletter and check the box authorizing you to receive offers from partners.

Registration for the draw is only effective after these steps have been completed.

Participation in the competition will only be valid if the information required by SYMMETRICS & SEASONLY is complete and correct. Any registrations made using incorrect, falsified information or via counterfeit or falsified forms will automatically forfeit any right to obtain any winning prize.

Each participant therefore undertakes to reveal correct information about themselves. SYMMETRICS & SESONLY disclaims any liability in the event that a participant uses false names and/or first names associated with a valid email address or a false email address.

4.2) Guarantees and liability for the validity of applications

SYMMETRICS and SEASONLY reserve the right to cancel, terminate or modify this operation if it does not proceed as agreed: any virus, bug, violation, unauthorized intervention, fraud, action of a competitor, technical problem or other cause beyond the control of SYMMETRICS and SEASONLY altering and affecting the administration, security, fairness, integrity, or conduct.

In general, the Participants guarantee the Organizers of this competition against any recourse, action or claim that could be made, for any reason whatsoever, by any third party, under all the guarantees and commitments made.

Any incomplete or erroneous participation will be rejected, without the Organizers being held liable.

All participants agree to comply with the rules. Any failure to comply with the rules by the Participant and any fraud, abuse, cheating, false declaration will result in their exclusion from the competition without the Organizers being held liable.

Thus, the Organizing Companies reserve the unconditional right to moderate a posteriori and not to validate, or even exclude or remove from the competition, any participant who does not respect one of the conditions of these rules.

Furthermore, in the presence of abuse or cheating by one or more participants, SYMMETRICS and SEASONLY reserves the right to modify or terminate the competition without notice, in particular when the integrity of the competition is called into question in its object.

4.3) Drawing procedures

The Winners will be determined by a random draw which will be carried out, on the date mentioned above, in the database of persons registered according to the conditions mentioned above.

Article 5 – Endowments/lots

5.1) Commercial value of the endowments

Lot 1 is offered by the company SYMMETRICS and constitutes in this sense an “endowment”.

The designated prize is as follows: 1 voucher of €150 to be used on the website and mobile application www.thebradery.com valid until 06/30/2023.

– Promotional codes cannot be combined with each other

Lot 2 is offered by the company SEASONLY and constitutes in this sense an “endowment”.

The designated prize is as follows: A one-hour treatment in a Seasonly studio (worth €130), valid until 10/01/2023.

5.2) Terms of recovery, use and renewal

As provided for in Article 6, the Winners must contact SYMMETRICS or SEASONLY directly and comply with the terms of use defined.

The lots offered cannot give rise to any dispute as to their nature or to the delivery of any consideration of any nature whatsoever.

 

Article 6 – Conditions for awarding lots

SYMMETRICS will deliver one (1) prize to one (1) Winner and SEASONLY will deliver one (1) prize to one (1) Winner. There will therefore be one (1) SYMMETRICS and SEASONLY prize for one (1) natural person.

Once the Winner has been designated by SYMMETRICS and SEASONLY, he/she will be contacted via the email address used when participating in the competition.

All email exchanges between the Organizer and the Winner will be kept in the Professional's email box.

The winner will be invited by return email to provide their precise contact details (last name, first name, address, city, postal code, telephone number, email address) in order to benefit from the prize won.

If the information provided by the Participant is incomplete and/or does not allow him to be informed of his winnings, he will lose the status of Winner and will not be able to make any claim.

The Organizer cannot be held responsible in the event of technical deficiencies regarding this electronic notification of winning. If the Winner does not provide this information within 10 days, he/she will lose his/her status as Winner.

If necessary, a second draw will take place.

Article 7 – Conditions of use

THE BRADERY: Vouchers cannot be combined with each other. Voucher valid until 06/30/2023 inclusive.

Article 8 – Personal and nominative data

The Players authorize in advance, by the sole fact of their participation, that the Organizers freely use for advertising or promotional purposes regardless of the medium, all personal information communicated on their behalf and on all media.

The personal data collected about you are mandatory and necessary for the processing of your participation in the game. They are intended for the Organizers, or for subcontractors and/or service providers for management needs.

In accordance with current regulations, the information collected is intended exclusively for the Organizers and will not be sold or transferred to third parties in any way whatsoever.

The information communicated by the Participant is intended for use by SYMMETRICS and SEASONLY in the context of access to its service in accordance with the general conditions of sale and in the context of the management of this game.

Any person is deemed to have read, understood and accepted, without reservation, the rules in their entirety, and in particular the article relating to personal data, as soon as they access and register for the competition.

 

Article 9 – Responsibilities and rights

The Organizers:

• Reserve the right to modify, extend, shorten, limit winnings or cancel this game in the event of force majeure as defined by case law. Consequently, they cannot be held liable for this.
• Cannot be held responsible for the fraudulent use of a Participant's connection rights or allocation of a prize.
• Disclaim all liability in the event of a malfunction of the internet network, telephone lines or reception equipment preventing the game from running smoothly. Furthermore, they cannot be held liable under any circumstances for problems with delivery or loss of electronic or postal mail.
• Disclaim all liability in the event of technical failure, anomaly, hardware or software of any nature (virus, bug, etc.) caused to the Participant's system, their computer equipment and the data stored therein and the consequences that may result from this on their personal, professional or commercial activity.

Participants:

• Are held responsible for the conformity of the information transmitted to the Organizers

 

Article 10 – Exclusion conditions

Participation in the game implies full and complete acceptance of the terms and conditions set out in these rules without any reservation or prior condition on the part of the Participant, failure to comply with said rules, resulting in exclusion from the competition, the pure and simple nullity of his/her participation and the awarding of prizes.

 

Article 11 – Filing of the regulations

All documents are made available and accessible in French to all users and Participants during the duration of the game. They are asked to make a backup copy and/or print all texts in order to be able to refer to them, if necessary.

 

Article 12 – Participation fees

Organized play is free and without obligation to purchase.

 

Article 13 – Competent jurisdictions

These regulations are subject to French law.

In the event of a dispute or claim concerning the competition for any reason whatsoever, requests must be sent in writing to the attention of the company SYMMETRICS or SEASONLY by mail to the address mentioned in the preamble, during the duration of the competition and at the latest within sixty (60) days after the designation of the Winners.

In the event of a dispute or claim regarding the prize awarded, requests must be addressed:

• To the attention of Customer Service by email at hello@thebradery.com. within seven (7) days of receipt of price confirmation;

OR

• To the attention of SEASONLY by email at wecare@seasonly.fr within seven (7) days of receipt of price confirmation.

The parties shall endeavour to resolve amicably any dispute arising from the interpretation or execution of these regulations. If the disagreement persists, it shall be submitted to the competent courts.

The Participant acknowledges having read these rules, accepting them without reservation and complying with them.
